			<content:encoded><![CDATA[<p align="center"><em>Bill revises Lacey Act</em><em> </em></p>
<p><strong>WASHINGTON, D.C. –</strong> Sen. Rand Paul today introduced the Freedom from Over-Criminalization  and Unjust Seizures Act of 2012 – or FOCUS Act. This bill removes each  and every reference to “foreign law” within the Lacey Act and  substitutes the Lacey Act’s criminal penalties with a reasonable civil  penalty system. Sens. Tom Coburn (R-Okla.), Jim DeMint  (R-S.C.), Mike Lee (R-Utah) and James Risch (R-Idaho) are co-sponsors  on this legislation.</p>
<p>“It  is long overdue that the Lacey Act be revised to address its broad  overcriminalization,” Sen. Paul said. “We have seen the damage this  extremely broad  and vague law has done to American companies and it is time to change  its language to better serve Americans and the American jobs it  threatens.”</p>

<p><strong><em>Background on the Lacey Act:</em></strong></p>
<p>The  Lacey Act is a conservation law that attempts to prohibit trafficking  in “illegal” wildlife, fish and plants. Since 1900, when the bill was  first signed  into law, subsequent amendments (the Lacey Act was amended in 1935,  1969, 1981, 1988, and most recently, in 2008) have produced what today  is an extremely broad and vague law that contains harsh criminal  penalties. Notably, the original Lacey Act, named after  Iowa Congressman John Lacey, contained a penalty “not exceeding two  hundred dollars.” There was no provision imposing jail or prison time.</p>
<p>The  Lacey Act now serves as a high-profile and frightening example of  over-criminalization. Victims include David McNab and Abner  Schoenwetter, who spent years  in federal prison for “violating” invalid Honduran fishing regulations  and, most recently, Henry Juszkiewicz, the Chairman and CEO of Gibson  Guitar Corp., whose company was raided by armed federal agents this past  August.</p>
<p>During  a hearing regarding the 1981 amendments to the Lacey Act, a  representative from the National Rifle Association (NRA) specifically  voiced civil liberties  concerns with the bill, stating that their “first concern [wa]s with  the broad expansion of criminal liability.” Under the existing Lacey Act  at that time, violations could only be prosecuted as misdemeanors, not  felonies. However, the 1981 amendments expanded  the potential penalties to allow for felony convictions.</p>
<p>In <em>Sykes v. United States</em>, 131 S. Ct. 2267, 2288 (2011), Justice  Scalia stated in his dissent that: “We face a Congress that puts forth  an ever-increasing volume of laws in general, and of criminal laws in  particular. It should be no surprise that as the  volume increases, so do the number of imprecise laws . . . In the field  of criminal law, at least, it is time to call a halt.”</p>
<p>The  Lacey Act as currently codified is overly broad, imprecise, vague, and  subject to abuse by overzealous prosecutors and activist judges.</p>

Rand Paul today took to the Senate floor to introduce an  amendment to the Stop Trading on Congressional Knowledge (STOCK) Act.  The amendment would bring an end to the revolving door between federal  employees and companies lobbying for federal funding or loans. This  corrupt relationship has led to billions in wasted  taxpayer dollars—money awarded on highly debatable grounds to companies  who were better politically connected than they were capable of  actually repaying a government loan.</p>

<p>Mr.  President, I ask unanimous consent to set aside the pending amendment  and call up amendments 1484, 1485 and 1487 en bloc. I ask unanimous  consent that the reading  of the amendments be dispensed with.</p>
<p>These  amendments are recognizing what the authors of these bills have been  discussing, that people should not profit off of their involvement in  government. They shouldn&#8217;t  profit off of special relationships. They shouldn&#8217;t profit off of  special knowledge they gain in the function of serving the people.</p>
<p>Currently  there are some large donors that have been giving to this  Administration who have profited enormously and disproportionately.</p>
<p>This  will allow this bill to apply to the Administration, and I don&#8217;t  believe people who are multimillionaires and billionaires should use the  apparatus of government  as was used in the loans that were given to Solyndra by someone who is  profiting off of their relationship and ties to the President, profiting  off of people who used to work for these companies now, who are now  employed in the administration and using these  connections to get taxpayer money to go to private individuals.</p>
<p>This  is wrong and this should stop. I think this bill is a great vehicle for  discussing how people in government are abusing their roles in  government to make more money  at the expense of the taxpayer.</p>

<p><strong>BACKGROUND:</strong></p>
<p><strong>Below are a few examples of this corruption and its proximity to the current Administration.</strong></p>
<p><strong><span style="text-decoration: underline;">SOLYNDRA</span></strong></p>
<p>Before  Solyndra’s bankruptcy in September 2011, the Department of Energy  awarded them a highly-favorable $528 million loan, and the Department of  Energy’s loan advisor  promised to recuse himself because his own wife’s law firm represented  Solyndra then, ultimately, refused to recuse himself and actually argued  for the loan. As a result, a company doomed to failure which had based  itself on a flawed business model nonetheless  received a $528 million loan courtesy of American taxpayers—money the  taxpayers will never get back.</p>

<p>BrightSource  Energy’s former chairman was John Bryson, who is now Secretary of  Commerce. The company was teetering on the brink of failure when in  April 2011 the Department of Energy  stepped in and offered them a $1.6 billion loan guarantee. The  Department of Energy advisor on that case had joined the government from  VantagePoint Partners, which was itself a major stakeholder in  BrightSource.</p>

<p>Steve  Westly, a member of the Secretary of Energy’s advisory board, an Obama  campaign bundler and a major investor in Tesla Motors boasted of his  proximity to the Administration’s  interest in green energy. Tesla received a significant Energy  Department loan in 2009, while Westly remains a shareholder in the  company.</p>

			<content:encoded><![CDATA[<p><strong>WASHINGTON, D.C. –</strong> Today, Sen. Rand Paul announced he will submit an amicus brief  supporting a recent lawsuit filed by the National Right to Work  Foundation (NRTW), the National Federation of  Independent Business (NFIB) and others, challenging the legality of  President Barack Obama’s recess appointments to the National Labor  Relations Board and Consumer Financial Protection Bureau. Sen. Paul  released the following statement following the court  challenge:</p>
<p>“With  the recent recess appointments, President Obama has circumvented our  Constitution and showed complete disregard for the separation of powers.  He has demonstrated once again that he is willing to treat  the office of the Presidency like a dictatorship,” Sen. Paul said.</p>
<p>“I  intend to file an amicus brief and join the NRTW, the NFIB, and others  in a lawsuit challenging the constitutionality of President Obama’s  appointments,” Sen. Paul concluded.<br />
Also today in the U.S. Senate, Sen. Paul took to the Senate floor  condemning the President for his unconstitutional usurpation of power.  Below is the video and transcript of his address.</p>

<p>I rise today in defense of the Constitution.</p>
<p>I rise today to condemn the President for making appointments that are  unconstitutional and illegal. Recently the President appointed members  to the National Labor Relations Board and to the Consumer Financial  Protection Agency. He did so by saying we were  in recess. Well this is news to us, because those of us in the Senate  maintain that we were never in recess.</p>
<p>This  is something where the President has usurped a power, never previously  taken by a president. And has decided unilaterally that he gets to  decide when were in recess. These appointments  are illegal and unconstitutional. And I’m surprised. I am surprised  that no member of the majority party has stood up to tell the President  so.</p>
<p>Now  I am not surprised that the President has engaged in unconstitutional  behavior. His health care law is brazenly unconstitutional. His war with  Libya was unconstitutional, he got  no Congressional authority. So for a man who once gave lip service to  the Constitution, the President now has become a president who is prone  to lawlessness and prone to unconstitutional behavior.</p>
<p>Our  founders clearly intended the president have the ability and the power  to appoint advisors. But they also separated that power, and gave that  power to the Senate to advise and  consent on these high-ranking officers in government.</p>
<p>The  President has gone and end a round on this and has done something that  breaks with historical precedent. It goes against the notion of checks  and balances. In fact, the notion  that underlies the whole idea of recess appointments is mostly a  historic relic.</p>
<p>Alexander  Hamilton explained in Federalist 67, the power was included so that the  Senate did not have to remain in session year-round to deal with  nominations. But this  was also done in a time when Congress would go out of session for  months at a time, to return to their farms and return to their  businesses. Now Congress meets nearly year round.</p>
<p>So  in other words, recess appointments should only happen rarely, and only  in extreme occurrences, if at all. There also should be agreements that  we are in recess and  there is no agreement that we were in recess.</p>
<p>There  is a lot of talk about bi-partisan cooperation on the other side of the  aisle. But I am disappointed that not one Senator has stood up to tell  the President that this sets a  terrible precedent. That this is a usurpation of power, that is bad for  the country. Bad for the idea of checks and balances.</p>
<p>I  am disappointed that not one Senator from the other side of the aisle  has stood up to oppose this President on this unconstitutional power  grab. This is an opportunity for us to  stand together in defense of the Constitution.</p>
<p>I  state now unequivocally that if a Republican President tries to usurp  this power, if a Republican President tries to define a recess and  appoint people illegally, I will stand here  on the floor and oppose him.</p>
<p>This  is not about being a Republican or Democrat; it’s about having respect  for the Constitution and these lawless, illegal, and unconstitutional  appointments fly in the face of the  respect for our Constitution.</p>
<p>This  is an issue of separation of powers, of Constitutional authority and of  Senate prerogative. It is sad, that not one member of the opposition  party will stand up for the Constitution;  will stand up to the President.</p>
<p>Make  no mistake, this is a huge breach of precedent. If the President is  allowed to determine when we are in recess, nothing prevents him from  making recess appointments this evening  at 8 o’clock; or on the weekend.</p>
<p>If  this is allowed to stand, if this precedent is allowed to stand nothing  stops the President from appointing a Supreme Court justice tonight at  8:00. Is that the kind  of lawlessness we want in our country? Are we going to completely  abandon the advise and consent role of the Constitution and of the  Senate?</p>
<p>I  ask today is there not one Senator from across the aisle who will stand  up against this unconstitutional power grab? Is there not one Senator  from across the aisle who  will say to the President, that these illegal appointments set a  terrible precedent? That these appointments will encourage a  lawlessness, that these appointments eviscerate the advise and consent  clause of the Constitution?</p>
<p>I  ask my colleagues from across the aisle, where is your concern for the  checks and balances? Where is your concern for the Constitution?</p>
<p>I  am greatly saddened by this and I hope the President will reverse  course. I hope the majority party in the Senate will stand up for the  Constitution, but I am greatly  disappointed in where we are in this debate.</p>

			<content:encoded><![CDATA[<p><strong>WASHINGTON, D.C. – On Monday, </strong>Sen.  Rand Paul was scheduled to speak at the 2012 March for Life on the  National Mall in Washington, D.C., but was improperly detained by the  TSA  and forced to miss the event. However, after the rally, Sen. Paul  hosted a reception welcoming marchers from Kentucky and those across the  country. Below are the remarks Sen. Paul would have delivered at the  2012 March for Life.</p>
<blockquote><p>“The  question remains, can a nation long endure or can a civilization long  endure that does not respect Life? Our Liberty comes from our Creator  and our freedoms depend upon a respect for  Life.</p></blockquote>
<blockquote><p>In  order to protect the unborn from the very moment life begins, I  introduced the Life at Conception Act during my first year in the  Senate. I have also cosponsored  several other pro-life bills including the Life at Conception Act, the  Protect Life Act, the No Taxpayer Funding for Abortion Act, and the  Child Interstate Abortion Notification Act.</p></blockquote>
<blockquote><p>I  also strongly support a Human Life Amendment to the U.S. Constitution,  which would confirm in law that an unborn child is a person entitled to  the right to  life and support legislation that would restrict federal courts from  hearing cases involving abortion. State governments must be allowed to  implement laws that protect life.</p></blockquote>
<blockquote><p>It  is the government’s duty to protect life, liberty, and property, but  primarily and most importantly, a government must protect life. Today,  tragically our  nation wavers; our moral compass is adrift. Today, I worry about our  nation&#8217;s future. Together a brighter tomorrow is possible if we join  hands to restore our nation&#8217;s virtue.</p></blockquote>
<blockquote><p>To  respect life and to listen to the voice of God that lives and breathes  and beckons and yearns for our attention. When America remembers and  restores her  respect for life, when America refinds her moral bearings then we will  thrive again, then we will find our way.</p></blockquote>
<blockquote><p>I will never give up fighting for the lives of our unborn children. May God bless America.”</p></blockquote>

<p><strong>TRANSCRIPT:</strong></p>
<p>One thing is for certain: President Obama is in full campaign mode.</p>
<p>In  last year’s State of the Union Address, President Obama came before  Congress with lofty promises to the American people of job creation, a  prosperous economy  and American innovation.</p>
<p>He  told Americans that we were going to ‘win the future.’ But now, a year  later, his focus has clearly changed from winning the future, to winning  re-election.</p>
<p>Instead of working with Congress – the President simply wants to shift the blame.</p>
<p>In  the past year we have seen these promises fail miserably. And while the  President would like to blame the Republicans in Congress for inaction,  the responsibility  clearly lies on his shoulders.</p>
<p>I,  as well as other Republicans, have offered to help the President fix  our country’s debt problem; to fix our entitlement debacle. But the  President seems  more intent on riding his Canadian bus and bashing rich people than  working with Congress to fix the nation’s problems.</p>
<p>While  the President continues to blame Congress for America’s current  turmoil, the American people aren’t blind to his runaway Administration.  They are starting  to question the unnecessary spending and constricting regulations  implemented by this administration. Government is not the answer to ALL  our economic and social ills, and the American people see that.</p>
<p>The  government’s current spending is out-of-control. The debt is not just a  bunch of numbers; it has a face and a name. Economists estimate that  our debt  is currently restraining the growth of our economy by about one percent  and costing over 1 million jobs.</p>
<p>Through  his stimulus spending plans, this President is on course to add more  debt than all 43 previous Presidents combined, and yet unemployment  still lingers  near 10 percent. Since the President took office, over 2 million new  workers are out of work.</p>
<p>Last week, President Obama was given the opportunity to turn America in the right direction.<strong> </strong>The Keystone pipeline would instantly create thousands of jobs  without costing the taxpayers a dime.  It would also strengthen our  alliance with neighboring Canada and wean our energy dependence from the  Middle East.   The Keystone pipeline was in America’s  best interest. Yet the President rejected this pipeline and the  American people, by siding with the liberal environmentalists  instead.&#8211;just as he did with Solyndra.</p>
<p>As we heard tonight, this President still believes big government is the answer.</p>
<p>But  the American people want the government to get out of their way. They  want to be left alone. They want to run their businesses as they please  without  job-killing regulations and taxes suffocating their prosperity.</p>
<p>The  President spoke tonight on shared sacrifice and tax reform. Except, his  idea of reform isn’t lowering rates for everyone or simplifying a tax  code that  is far too complicated. It isn’t a reform based on fairness or common  sense economics. Instead, President Obama’s idea of tax reform is one  built on the foundation of class envy.</p>
<p>Our  system of free enterprise rewards hard work, prosperity, and success  and that is what we should embrace. We should be proud of that system  that has made  our country the wealthiest and most humanitarian nation in the history  of the world. The way forward is to embrace what we know works:  decreased government spending, lower taxes, and a lessened regulatory  burden.<strong> </strong></p>
<p>The  EPA regulations alone, that have been implemented by the Obama  Administration have cost over five percent of our annual GDP— the  equivalent of the costs of our national security and homeland security  combined—and since EPA regulations have expanded, unemployment in  America has increased by 33 percent.</p>
<p>The  President’s vision for America differs from ours. We believe, as  President Reagan said in his inaugural address, that “government is the  problem not the  solution.”</p>
<p>Only by unleashing the greatness of American individualism can we grow our way out of this recession.</p>
<p>I  hope the President will come to understand this and that he will work  with Republicans to get an overzealous federal government out of the  way. When he  gives up on bipartisanship, he gives up on our nation.</p>
<p>Ultimately,  we want representatives in Washington who respect and admire business,  the free market, and the individual. That day cannot come soon enough.  I continue to invite the President to work with us, as I have asked him  several times before. It is time for him to set aside his political  agenda, and work together to get our country to get back on our feet  again.</p>
<p>Unless  the President starts working with Congress on behalf of the prosperity  of the American people, we can only assume his words tonight were no  more than  empty promises.</p>

			<content:encoded><![CDATA[<p><strong>WASHINGTON, D.C. –</strong> For the past several months, Sen. Rand Paul has opposed and led the  charge against both the PROTECT IP Act (PIPA) and the Stop Online  Piracy Act (SOPA). Today, Sen. Paul issued the following statement.</p>
<p>“The  Internet, as we know it, has had a profound impact on job creation, the  global economy and prosperity. It has accelerated wealth creation and  facilitated  a more connected world. But the Internet’s development is based on the  free flow of information, innovation, and ideas, not central government  control,” Sen. Paul said.</p>
<p>“Both PIPA and SOPA give the federal government unprecedented and unconstitutional power to censor the Internet. These  bills enable the government to shut down websites that it deems guilty  of violating copyright laws. While we support copyright protections, we  are also concerned about websites being shut down  without their day in court, and making innocent third parties bear the  costs of solving someone else&#8217;s problems.&#8221;</p>
<p>Sen.  Paul concluded, “I will not sit idly by while PIPA and SOPA eliminate  the constitutionally protected rights to due process and free speech. For  these reasons, I have pledged to oppose, filibuster and do everything  in my power to stop government censorship of the Internet.”</p>

			<content:encoded><![CDATA[<p><strong>WASHINGTON, D.C. –</strong> U.S. Sen. Rand Paul today announced that he is returning $500,000 to  the United States Treasury – money unspent from his official operating  budget. The total amount being returned is more than 16 percent of  Paul’s original office budget. As far as is known, no U.S. Senator has  returned as much to taxpayers.</p>
<p>“I ran to stop the reckless  spending,” said Paul. “And I ran to end the damaging process of elected  officials acting as errand boys, competing to see who could bring back  the biggest check and the most amount of pork.”</p>
<p>At a press  conference today in Louisville, Paul presented taxpayers with an  “over-sized check” for $500,000, representing the money being returned  to the Treasury.</p>
<p>“I hope this sets an example for the rest of  government – at all levels,” said Paul. “We can carry out our duties in a  fiscally responsible way. Government can be both smart and efficient.  We are proving that – and trying to convince the rest of Washington.”</p>

<p>Paul  achieved the savings while also having the most active office for a  freshman in the U.S. Senate. In his first year, he introduced more  legislation and amendments than any other freshman legislator, often  teaming-up with fellow Senators to support legislation.</p>
<p>Paul has  offered spending cut amendments to nearly every bill. And he has stood  up for Kentucky, offering bills in support of the Commonwealth’s bridges  and ports, and working to stop the Environmental Protection Agency’s  war on coal.</p>
<p>Paul’s office was one of only three in Washington to  produce an entire fiscal blueprint for the federal government, a  promise he made while campaigning in 2010. His plan, introduced in the  first few weeks of his term, would balance the federal budget in five  years.</p>
<p>Paul also kept his promise to work to reform Social  Security. His proposal, introduced with Sens. Lindsay Graham and Mike  Lee, would fix the entire system for 75 years. Later this month, Sen.  Paul will introduce a plan to save Medicare.</p>
